Biography

Nick Schneider’s practice is focused in the areas of business and commercial law, commercial litigation and employment and labor law.  He has extensive experience in employment litigation in federal and state courts.

Nick has handled or tried cases in many state and federal courts in the United States, including cases in the District of Minnesota, Eastern District of Kentucky and Northern District of Alabama, as well as in Oklahoma.  Over the years, this has included cases relating to claims involving the Civil Rights Acts, Employee Retirement Income Security Act (ERISA), Fair Labor Standards Act (FLSA) and the Fair Credit Reporting Act.  

After law school, Nick worked as a law clerk to Judge Allen E. Barrow, Chief Judge, U.S. District Court for the Northern District of Oklahoma.  Thereafter he served as a legislative assistant for U.S. Senator Henry Bellmon in Washington, D.C., with responsibilities which included involvement with the Appropriations Committee.

In addition to his practice, Nick speaks to other attorneys and business leaders at seminars concerning a wide range of legal issues.  In the fall of 2007, he led a presentation for clients and friends at the Cherokee Casino, Port of Catoosa, entitled "Employment Law Update." The topics presented included the new Oklahoma immigration law, strategies for the prevention of workplace violence and other subjects of interest to clients and friends.  He also made a presentation for members of the Tulsa Chamber of Commerce on the subject of “HIPAA in the Workplace."

Nick is the author of Oklahoma Garnishment/Income Assignment Manual (2007), which is provided to clients and friends to assist them in complying with the myriad of Oklahoma garnishment and income assignment laws.

 

Representative Experience

  • Acted as lead counsel for the plaintiff class in Envirosolve, LLC, et al, v. ePeo Link, Inc., et al., Case No. 03-CV-635-TCK-FHM, a complex ERISA-related class action involving a defunct health plan. The settlement of the case resulted in a recovery of several million dollars for plan participants.
  • Representation of trademark owner in suit by claimant asserting priority of claim to disputed mark
  • Represented major shareholder in corporate dissolution litigation which ultimately resulted in recovery after controversy was resolved in federal bankruptcy court
  • Appointed by federal judge to act as defendants’ liaison counsel in truck driver class action litigation which was successfully concluded for defendants
  • Successfully prosecuted claim against infringers of client’s trademark of computer domain website
  • Successful representation of pension plan in claim against plan administrator for defaults
  • Successful representation of clients in arbitration proceedings in a complex matters involving the design and development of software including design of the Source Code and other related components
  • Successful representation of clients in matters involving copyright and trademark infringement, unfair competition and cyber piracy
  • Successful defense of client in pregnancy act dissemination claim
  • Obtained an injunction in an action to enforce residential architectural requirements and covenants
