Biography

Shawn Harrell is an experienced trial lawyer whose litigation and arbitration practice encompasses commercial, business, employment, tort, product liability and construction-related matters.  He has represented individuals as well as local and national clients in disputes involving areas such as business torts, contract issues, employment matters, personal injury, construction and product liability.

Shawn has handled lawsuits in several states as well as numerous appellate matters, including the landmark decision of Christian v. Gray, 2003 OK 10, 65 P.3d 591, in which the Oklahoma Supreme Court adopted the Daubert line of federal cases.  In adopting the Daubert standards for expert witnesses in Christian, the Oklahoma Supreme Court upheld the trial court's decision to exclude plaintiffs' expert witness on causation in a toxic tort case.  This lead to a dismissal of the lawsuit and more than a dozen other lawsuits that had been filed against the defendant arising from the same occurrence.

Outside his practice of law, Shawn is an advocate for colon cancer research, treatment, screening and awareness.


Representative Experience

  • Representation of companies in employment litigation and arbitration.  Shawn has defended several local and national companies in a variety of matters involving employment discrimination, including claims arising under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA) and the Age Discrimination in Employment Act (ADEA).  He also represents employers before the EEOC and various state human rights agencies as well as provides sexual harassment and hiring practices training.
  • Representation of individuals and companies in business and commercial litigation and arbitration, including franchisor/franchisee litigation.  Shawn's experience in these areas ranges from general business disputes to wrongful expulsion suits brought against an LLC by one or more of its members.  His experience includes representing a major temporary staffing company in a lawsuit brought by it against one of its franchisees for breach of a franchise agreement.
  • Representation of companies in product liability and personal injury lawsuits. Shawn has defended a top automobile parts distributor in several cases in Oklahoma involving product liability and personal injury lawsuits.
  • Representation of companies in disputes involving the enforcement of non-competition and confidentiality agreements, breach of employment contracts and other matters arising from the employer/employee relationship, including commission and bonus disputes.  In one such case, Shawn and one of his partners defended a company in a lawsuit involving the alleged breach of an employment agreement containing a non-competition provision.  After a two-week trial, the jury rendered a unanimous verdict in favor of our client.
  • Representation of companies in construction litigation and arbitration.  Shawn has successfully represented a top construction company in several arbitrations and trials throughout the state.  His experience also includes the enforcement of arbitration agreements in not only the construction industry, but in other industries as well.
