Judge's ruling on gaming case keeps Tahlequah casino open

A Tahlequah, OK, casino owned by the United Keetoowah Band of Cherokees will remain open indefinitely after U.S. District Judge Ronald A. White sent a court case back to Indian gaming regulators. The tribe is represented by McAfee & Taft.

Jim McMillin, a shareholder with the firm's litigation group, was quoted in The Oklahoman article about the compexity of the issue, which now goes back to the National Indian Gaming Commission for further review and a final determination.

At issue is whetther the casino is located on federal trust land, as required by law.  The casino has operated since 1991, and the Indian gaming commission has collected fees and conducted on-site inspections since 1993.
