10th Circ. Panel Tosses Oil Co.’s Damages Claims

McAfee & Taft trial lawyers Jodi Cole and Riane Fern secured an appellate victory for an oil and gas exploration and production company on March 14, 2017, when a Tenth Circuit panel affirmed a district court’s dismissal of a lawsuit brought against their client. In the lawsuit, Max Oil Company Inc. claimed Range Resources-Midcontinent LLC permanently damaged three of its producing vertical wells while Range was developing two of its own horizontal oil and gas wells.

As reported on Law360, the appellate panel affirmed the lower court’s ruling that the plaintiff’s claims were time-barred. The panel also disagreed with the plaintiff’s claims that it should have been given leave to amend its petition in the district court, saying the company never made a proper motion to amend.
