Annexation by Durant challenged

Oklahoma Farm Bureau and landowners in rural Bryan County have filed a lawsuit against the city of Durant protesting the annexation of land between Durant and Calera. At issue are 20-foot wide strips of land encircling vast acreages of unincorporated territory previously outside the Durant municipal limits.

The plaintiffs, which are represented by McAfee & Taft attorneys Jeff Todd and Amy White, claim the annexation of private property in 2005 did not meet legal requirements and, therefore, the ordinance should be declared invalid.

Oklahoma law requires that annexed land must be adjacent or contiguous with existing municipal limits. It also requires a municipality to prepare a plan for extending services to the proposed annexation. The plaintiffs contend no such plan for services exists.
