In their presentation at the Oklahoma Chapter of the Association of Corporate Counsel’s Spring 2017 CLE Breakfast in Oklahoma City, OK, trial lawyers Michael Avery and Ron Shinn compare and contrast the concepts of attorney-client privilege and work-product doctrine, discuss how attorney-client privilege is established, and review the steps corporate counsel should take to ensure attorney-client privilege can be utilized to protect emails, memos and other documents generated as part of an internal investigation.
The presentation includes a review of a 2016 Tenth Circuit Court of Appeals case in which a corporate employee claimed the attorney-client privilege of his employer and in which the questions of “Who is covered by attorney-client privilege” and “Who has the right to waive attorney-client privilege” were answered by the court.
