Speaking at McAfee & Taft’s EmployerLINC17 seminar in Oklahoma City in a presentation titled “Benefits, Executive Compensation and Privilege Issues You Should Be Thinking About,” employee benefits and tax lawyer Jennifer Callahan reviews the legal concepts of attorney-client privilege and the work-product doctrine and how each may be used to prevent disclosure of certain information by plan fiduciaries in the employee benefits context. The presentation includes a discussion of the fiduciary exception, engaging counsel to conduct self-audit reviews as a way to preserve privilege, and protecting privilege in internal investigations.
