Overview

Barbara Moschovidis is a trial and appellate lawyer whose civil litigation practice is concentrated in the areas of complex business and commercial litigation, resolution of energy-related disputes, and first-party insurance defense. In addition to managing the full litigation lifecycle — from discovery, case strategy, and budgeting to dispositive motion practice, trial presentation, and appeals — she also serves as a trusted advisor to clients regarding strategic litigation and risk management decision-making.

As part of her energy, oil, and gas practice, Barbara advises and represents upstream, midstream, and downstream energy companies in a broad range of litigation matters, including putative class actions, contractual disputes, personal injury claims, property damage claims, product liability claims, interpleader actions, and real estate disputes. Barbara has developed particular experience and achieved notable success representing pipeline companies in multi-parcel condemnation proceedings.

In the commercial litigation arena, Barbara represents publicly traded, privately held, and tribal businesses in disputes involving contracts, corporate governance and business ownership, business torts, intellectual property, and related employment matters.

A portion of Barbara’s practice is devoted to representing insurance carriers in litigation involving coverage disputes, property damage claims, and uninsured motorist insurance claims, as well defending insurers against allegations of bad faith, breach of contract, breach of fiduciary duty, fraud, negligence, and violations of state consumer protection laws arising under property and casualty, life and disability, and commercial general liability insurance policies.

Barbara’s achievements have earned her inclusion in The Best Lawyers in America (commercial litigation; insurance law) and Oklahoma Super Lawyers’ list of “Oklahoma Rising Stars,” which recognizes the state’s up-and-coming attorneys.

Representative Experience

  • Secured unanimous victory from the Oklahoma Supreme Court on behalf of one of the nation’s largest interstate pipeline systems regarding the necessity of pipeline easement takings under the power of eminent domain.
  • Secured unanimous jury verdict for Oklahoma-based pipeline company in eminent domain trial, limiting damages to $7,800 against $1 million claim, reducing commissioner’s award by more than 85%, and defeating attorney fee claim.
  • Prevailed in bench trial of landowners’ exceptions challenging publicly traded interstate pipeline company’s constitutional and statutory authority to condemn property; defeated temporary injunction seeking to prevent installation of pipeline on similar grounds.
  • Represented publicly traded energy company in putative multi-state class action regarding abandonment of ammonia pipeline and related easement rights.
  • Served as lead counsel in products liability action on behalf of global provider of integrated energy systems and solutions concerning the use of a dissolvable frac ball in a saltwater disposal well.
  • Successfully interpleaded over $1 million in proceeds from the sale of oil and gas production for upstream energy company, eliminating ongoing exposure for interest on unpaid proceeds and securing reimbursement of attorney fees.
  • Obtained dismissal of putative class action against natural gas utility for alleged violation of consumer protection laws related to charging convenience fees for credit and debit card transactions.
  • Prevailed in four-state federal venue dispute in commercial dispute involving alleged federal and state trademark infringement and unfair competition, securing client’s preferred venue and applicable law and obtaining dismissal of three competing lawsuits.
  • Dissolved ex parte Temporary Restraining Order and compelled arbitration in limited liability member dispute over ownership and control of oilfield products company.
  • Served as lead counsel in professional services partnership dispute involving expulsion of partner and valuation and redemption of partnership interest.
  • Served as lead counsel for tribally owned federal defense contractor in dispute with subcontractor over rejection of non-compliant components for military armored vehicles.
  • Served as lead counsel for flight simulation contractor in dispute with federal government regarding scope of performance under contract and Federal Acquisition Regulations and payment for same.
  • Secured 10th Circuit affirmance of summary judgment ruling in favor of FDIC in banking fraud case.
  • Secured 10th Circuit affirmance of summary judgment in favor of hospital in employment discrimination action.
  • Represented tribally owned entertainment company in premises liability actions in tribal court under limited waiver of sovereign immunity.
  • Obtained summary judgment, as well as attorneys’ fees and costs, on behalf of national insurance carrier in action filed by insured for bad faith, breach of contract, and other claims over insurer’s handling of claim.
