Overview

Over the course of his distinguished career, Kevin Blaney has established himself as one of Oklahoma’s foremost commercial and banking lawyers and a trusted advisor to numerous financial institutions across the state, particularly in the area of commercial lending and creditors’ rights. His long-standing relationships with his financial institution clients and deep understanding of commercial loan documentation and creditor remedies are the hallmark of his practice.

Kevin’s experience includes all facets of lending, including traditional real estate and asset-based loans, oil and gas loans, agricultural loans, tribal loans, SBA and USDA guaranteed loans, loans secured by U.S. government contracts, loans involving economic development agreements, federal and state historic tax credits, low income housing tax credits, and new market tax credits.

The earliest years of Kevin’s legal career, which began in 1977, were primarily devoted to the representation of creditors in commercial collection cases. Within just a few years, in the lead-up to a tumultuous decade marked by the oil bust and numerous bank failures across the state, he had transitioned his practice almost exclusively to matters affecting the banking industry. Since that time, he has represented and counseled numerous financial institutions and governmental agencies in a broad range of transactional and litigation matters and is highly regarded for his extensive experience in helping clients deal with troubled loans as well as analyzing, negotiating, and documenting all types of commercial loans.

Kevin’s achievements have earned him inclusion in The Best Lawyers in America (banking and finance law; banking and finance litigation; bankruptcy and creditor debtor rights/insolvency and reorganization law; business organizations; corporate law) and in Oklahoma Super Lawyers.

Prior to joining the firm, Kevin was the founder and senior partner of Blaney Tipton Hiersche & Odom, PLLC, a boutique commercial law firm in Oklahoma City, OK, that merged with McAfee & Taft in 2024.

Representative Experience

  • Represented a local Edmond-based community bank in the sale of its assets to a federally charted credit union, the first transaction of its kind involving a bank and credit union in Oklahoma.
  • Assisted one of Oklahoma’s largest banks in the restructuring and/or liquidation of a large portfolio of troubled loans acquired by the bank following its purchase of the assets of a smaller community bank that had been shuttered by the FDIC.
  • Assisted a community bank in rehabilitating its troubled real estate loan portfolio through a combination of loan restructuring and foreclosures of residential developments and single-family construction projects, frequently utilizing Oklahoma’s Non-Judicial Power of Sale Act to expedite the foreclosure process.
  • Represented a federal savings and loan bank in connection with hundreds of residential and commercial real estate foreclosures, followed by assisting the bank in developing sound strategies, policies and procedures for loan administration, loan covenant enforcement, and environmental liability issues.
  • Served as Oklahoma counsel for the Federal Saving and Loan Insurance Corporation, in its receivership capacity, by advising on numerous Oklahoma law issues, as well as representing the receiver in managing, liquidating and collecting distressed loans.
  • Represented the FDIC in assisting its administrator in managing, liquidating and collecting hundreds of millions of dollars in troubled loans following the collapse of The First National Bank and Trust Company in Oklahoma City, the largest bank failure in the state’s history. Also served in an outside general counsel capacity for the administrator, providing opinion letters and counseling on issues such as lien priority, mortgage covenant enforcement, mortgage loan servicing issues, oil and gas loans, enforcement of judgments, and post-judgment collection proceedings.
  • Following the failure of Oklahoma National Bank & Trust Co., and as part of an assistance agreement with the FDIC, represented new bank owner in successfully closing hundreds of commercial collection cases, including real estate foreclosures, oil and gas foreclosures, replevin actions, and other commercial litigation matters, within one year.
  • Represented the FDIC as receiver for Penn Square Bank in numerous actions against delinquent borrowers arising out of the bank’s failure in 1982. Also served as counsel and assisted with developing strategies for the application of FDIC rules, regulations and the emerging theories on the use of the D’Oench-Duhme principles and federal “Super Powers,” as well as adapting the policies and procedures for representation of the rapidly growing and evolving agency.
