Trade secrets come in all forms and types – from “secret sauce” recipes and new product prototypes to customer lists and company-designed templates – and more and more of this information is stored electronically, making it increasingly more vulnerable to theft by departing employees, contractors, vendors, hackers and competitors who seek to gain a competitive edge in the marketplace. In their presentation at EmployerLINC18: Workplace Issues In The News, labor and employment attorneys Lauren Barghols Hanna and Paige Good discuss the remedies available under the Defend Trade Secrets Act, a federal law that creates a federal private right of action for companies facing the theft of trade secrets by former employees, contractors and competitors. The session includes a review of an actual case in which McAfee & Taft lawyers successfully petitioned the court for an ex parte seizure of trade secrets on behalf of an Oklahoma client whose proprietary information was stolen by former management employees who left to start a competing company.
