Corporate Counsel’s Attorney-Client Privilege: Increasing power and decreasing risk

In their presentation at McAfee & Taft’s 2016 Corporate Counsel Seminar in Oklahoma City, OK, trial lawyers Kenneth Blakley and Jodi Dishman review and compare the concepts of attorney-client privilege and work-product doctrine and take a close look at a recent Tenth Circuit Court of Appeals case in which a corporate employee claimed the attorney-client privilege of his employer and in which the questions of “Who is covered by attorney-client privilege” and “Who has the right to waive attorney-client privilege” were answered by the court.

The presentation also includes a discussion of attorney-client privilege in the joint defense context, including pros and cons, and a review of best practices for counsel as it pertains to both attorney-client privilege and joint-defense (or common-interest) privilege.
