In their presentation titled “Failure to properly structure severance agreements,” McAfee & Taft labor and employment attorneys Roberta Fields and Nathan Whatley provide an overview of employment release requirements under Title VII, the Age Discrimination in Employment Act (ADEA), and the Older Workers Benefit Protection Act (OWBPA), as well as discuss what types of claims cannot be waived and included as part of a release.  They also review several case studies in which employers failed to properly draft and structure the severance agreements.
