In May of 2016, the U.S. Department of Labor released new Fair Labor Standards Act overtime regulations that expanded the eligibility of overtime for millions of employees who were previously classified as exempt. The effective date for implementation was set for December 1, 2016, but a federal judge in Texas blocked these regulations just days before the final rule was set to go into effect. Employers are now waiting to see if the DOL will issue a new rule in 2018.
In her presentation titled “FLSA Update” before the Western Oklahoma Human Resources Association, McAfee & Taft labor and employment attorney Paige Good reviews the status of the overtime regulations and discusses the importance of auditing your employee classification and pay practices. The presentation also includes a review of the DOL’s clarified stance on whether interns working for for-profit employers are subject to the Fair Labor Standards Act.
