On June 26, 2018, Oklahomans went to the polls and approved the legalization of medical marijuana, paving the way for a burgeoning new commercial industry in the state. While the law creates new business opportunities for investors, growers, processors and dispensaries, it also creates a myriad of new legal risks, concerns and challenges for those impacted both directly and indirectly by the industry.

All persons interested in growing, selling, or possessing medical marijuana or in transacting business with others in the industry must keep in mind that federal law makes it a crime for any person to knowingly or intentionally manufacture, distribute or dispense a controlled substance. (Controlled Substances Act, 21 U.S.C. § 831(a).). Federal law also makes illegal certain financial transactions connected to unlawful activity, including transferring monetary instruments or funds with the intent to promote the carrying on of specified unlawful activity, including the manufacture, importation, sale or distribution of a controlled substance. (Money Laundering Control Act of 1986, 18 U.S.C. §§ 1956, 1957.)
