Insights Into the Oklahoma Bar Association’s Disciplinary and Reinstatement Process
Speaking at a CLE seminar sponsored by the Alternative Dispute Resolution Section of the Oklahoma Bar Association, McAfee & Taft trial lawyer Gerald Hilsher provides background and insights on the jurisdictional and procedural roles of the Supreme Court, the OBA’s Professional Responsibility Commission (PRC), the OBA’s General Counsel’s Office, and the Professional Responsibility Tribunal (PRT) in assessing the need for discipline, the appropriate discipline to be applied, and in approving reinstatement of lawyers who have resigned under threat of discipline or by reason of a move to another jurisdiction. Such rules also identify issues concerning burden of proof, receipt of evidence, the formal reporting by the PRT to the Supreme Court, and the Supreme Court’s non-delegable duty to exercise its exclusive original jurisdiction and ultimate responsibility for imposition of professional discipline and approval of reinstatement of members to the roll of Oklahoma attorneys.
Gerald Hilsher has been a member of the Professional Responsibility Tribunal since 2014 and was reappointed in 2018 for a four-year term.
