Un-registered trademarks receive some protection under the common law and under the Lanham Act. However, registration of trademarks provides additional benefits and, substantive and procedural rights. Registration grants the right to use the registered trademark symbol, to file trademark infringement lawsuits, and restricts registration of similar trademarks.
