Medical Marijuana Business Issues and Risks
Despite the fact that medical marijuana is now legal in Oklahoma, it remains a Schedule I drug under the Controlled Substances Act. As such, anyone who engages in the manufacturing, distribution, dispensing or possession of medical marijuana is subject to numerous personal and business risks associated with violating federal law. Even those who do business with marijuana-related businesses — for example, landlords who lease space or businesses that sell supplies or equipment — are also at risk.
In their presentation at McAfee & Taft’s 2018 Corporate Counsel Seminar in Tulsa, Oklahoma, attorneys Elizabeth Dalton and Sam Merchant provide an overview of various business issues and risks associated with operating, investing in, or doing business with a marijuana-related business. Issues discussed in the presentation include insurance coverage, bankruptcy relief, tax deductions, banking accounts, mortgages and loans, intellectual property, the enforcement of legal contracts, and the sale or possession of firearms.
