ABA 2018 Emerging Issues in Motor Vehicle Product Liability Litigation

In her presentation at the American Bar Association’s 2018 Emerging Issues in Motor Vehicle Product Liability Litigation Conference, trial lawyer Sherry Rozell reviews the most significant changes to the Federal Rules of Civil Procedure from the last three years with a specific focus on the substantial revisions found in the 2015 Amendments and how they impact discovery.  These include:

  • New rules designed to increase the speed of litigation at the outset
  • Changes to Rule 26(b)(1) where “proportionality” is in and “reasonably calculated” is out
  • Amendment of Rule 34(b)(2)(B) to prohibit boilerplate objections
  • The application of sanctions under Rule 37(e)(1) when ESI that should have been preserved is lost
