While most employers are familiar with their obligations to engage in the interactive process to reasonably accommodate job applicants and employees with physical disabilities, far fewer understand that the Americans with Disabilities Act also applies to those with mental disabilities.
Speaking at McAfee & Taft’s EmployerLINC17 seminar in Oklahoma City in a presentation titled “Workplace Wellness: How to recognize, address and accommodate mental and emotional issues in the workplace,” labor and employment attorneys Anna Lukeman and Charlie Plumb explain the circumstances under which someone’s mental impairment may qualify as a disability, review the interactive process and possible accommodation options available to those with mental disabilities, and discuss the use of discipline in the context of a mental impairment.
